GENERAL TERMS AND CONDITIONS
for the sale of eBooks (electronic books), online courses, and English clubs for children
I. Introductory Provisions and Explanation of the Purpose of the General Terms and Conditions
These General Terms and Conditions (hereinafter referred to as the “GTC”) apply to the purchase of eBooks (electronic books) and online courses (hereinafter jointly referred to as “digital content” or “products”) via the web interface www.englishland.cz.
The purchase of products is based on a Purchase Agreement concluded between the Seller and the Buyer. The process of concluding the Purchase Agreement is described in detail in Article III of these GTC. These GTC form an integral part of the Purchase Agreement and set out and explain in detail the rights and obligations of both parties, i.e. the Buyer and the Seller. Any provisions in the Purchase Agreement that differ from these GTC shall prevail. These GTC also govern certain other matters related to the purchase of digital content or the use of the website www.englishland.cz.
These GTC contain information that you need to have available before purchasing a product. Please read them carefully and, if you have any comments or questions, contact me before placing your order. Contact details can be found in Article II of these GTC. By clicking the “Pay order” button, you confirm that you have read, understood, and agree to these GTC and to the course of business and cooperation described herein.

1. SELLER

2. BUYER
The Buyer is a person who concludes a Purchase Agreement with me as the Seller via the web interface www.englishland.cz and thereby purchases one of the products. The Buyer may be an entrepreneur (a self-employed individual or a legal entity, e.g. a limited liability company or a joint-stock company) or a consumer.
3. CONSUMER
A consumer is defined by law as a natural person who does not act within the scope of their business activity or independent profession. If you are a natural person and provide a company ID number in the order, it will be assumed that you are concluding the Purchase Agreement as an entrepreneur and not as a consumer.
4. CONSUMER CONTRACT
A Consumer Contract is a Purchase Agreement in which the Buyer acts as a consumer. Under applicable laws, consumers enjoy greater legal protection than Buyers who are not consumers. The Seller also has more obligations toward consumers and is required to provide them with information stipulated by both the Civil Code and the Consumer Protection Act. If the Buyer is not a consumer, those provisions of the GTC that serve exclusively to protect consumers shall not apply.
5. DISTANCE CONTRACT
A Distance Contract is a Purchase Agreement concluded using means of distance communication, i.e. without the Seller and Buyer meeting in person, via the web interface, email communication, telephone, or similar communication tools. Any costs associated with the use of distance communication means (in particular internet connection and telephone charges) are borne by the Buyer and do not differ from the standard rates charged by their service provider. By placing an order, you expressly agree to the use of distance communication means.
6. APPLICABLE LEGAL REGULATIONS
The relationship between the Buyer and the Seller is governed in particular by Act No. 89/2012 Coll., the Civil Code, and, where the Buyer is a consumer, also by Act No. 634/1992 Coll., on Consumer Protection.
III. Order and Conclusion of the Purchase Agreement
The Buyer orders products via the web interface, i.e. through an automated order system, by submitting a completed order form.
PRODUCT DESCRIPTION.
The web interface provides a detailed description of the offered products, including their content, intended audience, expected benefits, whether they are updated, and the format in which they are provided, as well as any additional conditions required for their effective use. Bonuses associated with individual products are also described. All presentations on the web interface are for informational purposes only. As the Seller, I am not obliged to conclude a Purchase Agreement for these products. Section 1732(2) of the Civil Code does not apply.ORDERING PRODUCTS.
To order products via the web interface, the Buyer completes an order form by providing their name, surname or company name, address, email address, and, in the case of entrepreneurs, company ID and VAT number, selects the payment method, and marks the selected product(s).
Before submitting the order, the Buyer may review and modify the entered details and correct any errors. The order is submitted by clicking the “Pay order” button.
You will be informed of the receipt of your order by email sent to the address provided in the order. This notification is sent automatically. If the confirmation does not explicitly state that the order has been accepted, I will send a subsequent email confirming acceptance. Until the acceptance confirmation is delivered, the order may be cancelled by phone or email. The Purchase Agreement is concluded upon delivery of the acceptance confirmation to your email address.
In case of doubt, I may contact you to verify the authenticity of the order. If verification fails, the order is deemed not to have been placed.
The Purchase Agreement is concluded in the Czech language, in electronic form, consisting of your order, its acceptance, and these GTC. The agreement is archived electronically and is not publicly accessible.
IV. Product Prices and Payment
PRODUCT PRICES.
The current price of each product is always stated on the web interface. The price remains valid for the duration of its display. Promotional prices are valid only under the stated conditions and time period. Due to the nature of the products, no delivery or additional costs apply. The total price shown before clicking “Pay order” is the final price.The agreed purchase price is the price stated at the time the order is submitted. In the event of an obvious pricing error, I am not obliged to deliver the product at the incorrect price, even if the order was automatically confirmed. If payment has already been made, I reserve the right to withdraw from the Purchase Agreement.
Unless expressly agreed otherwise, products are delivered only after full payment of the purchase price.
PAYMENT METHODS.
The purchase price may be paid by:
– Bank transfer
– Payment cards (VISA, MasterCard, Maestro)
– Online bank transfer
Payments are processed via the COMGATE payment gateway. Payment card details and online banking credentials are entered through COMGATE’s secure system. The purchase price is paid in Czech crowns; for international orders, in euros.
PAYMENT DUE DATE.
For bank transfers, payment is due within 7 days of order confirmation. Payment is deemed completed upon crediting the Seller’s bank account. For online payments, payment is due immediately. An invoice will be issued after payment.
Installment payments are not available for eBooks.
V. Delivery Conditions
METHOD OF DELIVERY.
eBooks are delivered in PDF or similar format via email or download link. Online courses are delivered by granting access to a user account. Lessons may be released gradually according to the course schedule.DELIVERY TIME.
Products are delivered within 3 business days after payment is credited. Online payments result in immediate delivery, except where courses start on a fixed announced date.The Buyer must check functionality immediately after delivery and report any issues.
Digital content requires appropriate hardware and software capable of opening PDF files.
Children’s English Club – Participation Conditions.
Payment is made for the entire semester/course. Missed lessons are not refunded or replaced. If a child misses more than 50% of lessons for serious reasons (e.g. long-term illness), a proportional refund will be provided.
VI. Functionality of Digital Content and Copyright Protection
Digital content is delivered exclusively to the Buyer. Internet access and compatible hardware/software are required. Temporary unavailability due to maintenance may occur.
Products are based on my experience and do not guarantee specific results. They do not replace personal consultation. All content is protected by copyright and may not be shared without prior written consent.
USER ACCOUNT.
The Buyer must keep login credentials confidential. I reserve the right to suspend or cancel access in case of serious breach of obligations or copyright infringement.
VII. Withdrawal from the Purchase Agreement
Consumers may withdraw from the contract within 14 days. Additionally, I provide a satisfaction guarantee allowing withdrawal within 14 days without stating a reason.
Refunds will be issued within 14 days using the original payment method.
Withdrawal may also occur in other cases stipulated by law or these GTC.
Any gifts or bonuses provided must be returned if the contract is withdrawn.
VIII. Warranty, Defective Performance, Complaints Procedure
Rights arising from defective performance are governed by applicable law.
The Seller warrants that the product is free from defects upon delivery.
Complaints must be submitted without undue delay and will be handled within 30 days.
IX. Complaints Handling and Consumer Dispute Resolution
Complaints may be submitted using the contact details in Article II.
Supervisory authorities include the Czech Trade Inspection Authority and the Office for Personal Data Protection.
Consumers may resolve disputes out of court through the Czech Trade Inspection Authority or the EU ODR platform.
The Seller is not bound by any codes of conduct.
X. Final Provisions
The Purchase Agreement is concluded for a fixed term until obligations are fulfilled.
Personal data protection is governed by a separate document available on the website.
The Seller reserves the right to amend these GTC; the version valid at the time of order submission applies.
These GTC are effective as of 6 January 2023.
